Who may use this limited warranty?
Lunas. (“Company”) warranties apply to Lunas light therapy devices (“Product” or “Products”), and only for Products, registered through lunaspanel.com on behalf of the consumer who originally purchased the Product ("Buyer"). This limited warranty applies to consumer use only and does not apply when the Product is used in a commercial or institutional setting.The Company warrants the Products against defects materials and workmanship when used normally in accordance with the applicable instructions for use provided in the operating and service manual for the Product during the applicable warranty period. During the warranty period, Company will repair or replace, at no charge, Products or parts of Products that prove defective because of improper material or workmanship, under normal use and maintenance.
The Company may change the availability of this limited Warranty at its discretion, but any changes will not be retroactive.
What will we do to correct the problems?
If during the applicable warranty period you submit a valid claim to the Company, Company will, at its option, (i) repair the Products at no charge, using new or refurbished replacement products or parts of Products, or (ii) replace the Product with a functionally equivalent product at no charge, or (iii) exchange the Product for a refund of the purchase price. Shipping and handling charges may apply except where prohibited by applicable law.For the first 120 days, the Company will be responsible for all shipping costs related to your request.
After the first 120 days, Buyer will be responsible for Product shipping charges and related coverage while in transit to Company. Company will be responsible for product shipping charges and related coverage to the Buyer while in transit.
Any replacement Product will be warranted for the remainder of the original warranty period.
How long does the coverage last?
The warranty period for Company Products registered through joovv.com depends on your purchased device and starts from the date of purchase. The Lunas modular devices come with a 60-day return period as well as a 2-year limited warranty. The limited warranty is not transferable and may be voided if the product ownership changes.
What does the limited warranty not cover?
This limited warranty does not apply to: (a) cosmetic damage; (b) damage caused failure to follow the product instructions or to perform any preventive maintenance; (c) modifications; (d) unauthorized repair; (e) damage due to transportation; (f) damage due to liquid contact; (g) damage due to storage; (h) theft or loss of the product; (i) defects caused by normal wear and tear or otherwise due to the normal aging of the Product; and (j) to damage due to external causes such as accidents, abuse, damage by natural causes like lightning, floods, or other natural disasters, or other actions or events beyond the reasonable control of the Company. In addition, component parts or products manufactured by a third party (“Third Party Product”) may constitute, contain, be contained in, incorporated into, attached to or packaged together with, the Product. Third Party Products are not covered by this Limited Warranty, and The company makes no representations or warranties with respect to any third-party product, including any (a) warranty of merchantability; (b) warranty of fitness for a particular purpose; (c) warranty of title; or (d) warranty against infringement of intellectual property rights of a third party; whether express or implied by law, course of dealing, course of performance, usage of trade, or otherwise.
Implied Warranties
Except to the extent prohibited by applicable law, all implied warranties (including, without limitation, warranties of merchantability and fitness for a particular purpose) shall be limited in duration to the duration of the applicable warranty period. Some jurisdictions do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you.
Limitation of Liability
Except as provided in this warranty and to the maximum extent permitted by law, the company is not responsible to buyer or any third party for direct, special, incidental or consequential damages resulting from any breach of express or implied warranty or condition, or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, compromise or corruption of data; or any indirect or consequential loss or damage howsoever caused including the replacement of equipment and property. The company’s liability shall under no circumstances exceed the actual amount paid by you for the defective product. Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.
The foregoing limitations shall not apply to death or personal injury claims, or any statutory liability for intentional and gross negligent acts and/or omissions.
